ABC merit shop contractors are facing their greatest challenge in 25 years. According to ABC National legal counsel Maury Baskin, the threat embodied by the potential passage of the ill-named Employee Free Choice Act, also known as the "Card Check" bill, is much worse than many of us realize. The bill can be likened to Armageddon for the business community. It is perilously close to passage now, and after the new Congress and President take office, it will be exceedingly difficult to stop it - but stop it we must. The unions are spending tens of millions of dollars to ensure passage, so we must redouble our efforts.
You need to know that if this becomes law, you can be organized without ever having the opportunity for your employees to hear your side. You need to know that your employees could be signing cards now without your knowledge, and that the cards are valid for one year. Uninformed employees will sign cards. Uninformed managers will make mistakes, and organizing will increase dramatically. And it's more than just the organizing threat. The bill contains language establishing mandatory arbitration and dramatically increases penalties for unfair labor practices ($20,000 per incident). President Obama is expected to appoint all pro-union people to the National Labor Relations Board and the courts, and those are the people that will be interpreting the new law, if it passes. The bottom line is - there will be no second chances!

We need you to join us in the fight by keeping the pressure on our U. S. Senators. While we are engaged in an all out effort to stop this bill from passing, we are creating more tools to help you create an immediate response plan. New materials are being prepared by ABC National now that will be available in approximately 30 days. For now, you can go to www.abc.org/cardcheck to access sample letters, talking points, paycheck stuffers, and other resources.
